Agreement to Terms

Welcome to Tacklr! These Terms of Service ("Terms") govern your access to and use of the Tacklr website, platform, and services (collectively, the "Services") operated by Tacklr.

By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Services.

We reserve the right to update these Terms at any time. Your continued use of the Services after any changes constitutes acceptance of the updated Terms.

Eligibility

To use Tacklr, you must:

  • Be at least 13 years of age
  • Have the legal capacity to enter into binding contracts
  • Not be prohibited from using the Services under applicable law
  • Provide accurate and complete registration information

If you are under 18, you must have permission from a parent or legal guardian to use our Services.

Account Registration and Security

Account Creation

To access certain features, you must create an account. You agree to:

  • Provide accurate, current, and complete information
  • Maintain and update your account information
  • Keep your password secure and confidential
  • Notify us immediately of any unauthorized access
  • Be responsible for all activities under your account

Account Termination

We reserve the right to suspend or terminate your account at any time for violations of these Terms, fraudulent activity, or any other reason at our sole discretion.

Subscription Plans and Payment

Free and Paid Plans

Tacklr offers both free and paid subscription plans:

  • Free Tier: Limited to 3 setups with basic features
  • Creator Pro ($15/month): Unlimited setups with advanced features

Billing and Payments

For paid subscriptions:

  • Subscriptions are billed monthly in advance
  • Payments are processed securely through Stripe
  • You authorize us to charge your payment method on a recurring basis
  • Subscription fees are non-refundable except as required by law
  • We may change subscription prices with 30 days' notice

Cancellation

You may cancel your subscription at any time through your account settings. Upon cancellation, you will retain access to paid features until the end of your current billing period. Your account will then revert to the free tier.

User Content and Conduct

Your Content

You retain ownership of all content you create on Tacklr, including fishing setups, product recommendations, descriptions, and profile information ("Your Content&quot). By posting Your Content, you grant us a worldwide, non-exclusive, royalty-free license to:

  • Display, distribute, and promote Your Content on our platform
  • Make Your Content publicly available to users and search engines
  • Use Your Content for marketing and promotional purposes
  • Modify or adapt Your Content for technical compatibility

Content Standards

You agree that Your Content will not:

  • Violate any laws or regulations
  • Infringe on intellectual property rights of others
  • Contain false, misleading, or deceptive information
  • Promote illegal fishing practices or endangered species
  • Include hate speech, harassment, or discriminatory content
  • Contain spam, malware, or malicious links
  • Violate the privacy rights of others

Prohibited Activities

You may not:

  • Use automated systems (bots, scrapers) to access the Services
  • Attempt to gain unauthorized access to our systems
  • Interfere with or disrupt the Services
  • Impersonate another person or entity
  • Create multiple accounts to circumvent plan limitations
  • Engage in any fraudulent activity
  • Reverse engineer or attempt to extract source code

Affiliate Links and Disclosures

Affiliate Relationships

Tacklr enables creators to share affiliate links to fishing products. You acknowledge that:

  • Creators may earn commissions from affiliate links
  • We may earn commission fees from creator earnings (when implemented)
  • Affiliate relationships must be disclosed in accordance with FTC guidelines
  • Product recommendations should be genuine and based on actual experience

Creator Responsibilities

If you include affiliate links in your content, you must:

  • Comply with all applicable affiliate program terms
  • Provide accurate product information and pricing
  • Not make false claims about products
  • Comply with FTC disclosure requirements
  • Use only authorized affiliate links

Third-Party Merchants

We are not responsible for products sold by third-party merchants. Any purchases made through affiliate links are between you and the merchant. We do not guarantee product quality, availability, pricing, or customer service from third-party merchants.

Intellectual Property Rights

Our Intellectual Property

All content, features, and functionality of the Services (excluding Your Content) are owned by Tacklr and protected by copyright, trademark, and other intellectual property laws. This includes:

  • The Tacklr name, logo, and branding
  • Website design, layout, and user interface
  • Software, code, and algorithms
  • Documentation and content we create

Limited License

We grant you a limited, non-exclusive, non-transferable license to access and use the Services for personal or commercial purposes in accordance with these Terms. This license does not include the right to reproduce, distribute, modify, or create derivative works.

Copyright Infringement

Disclaimers and Limitations of Liability

Service "As Is"

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • Warranties of merchantability or fitness for a particular purpose
  • Warranties that the Services will be uninterrupted or error-free
  • Warranties regarding the accuracy or reliability of content
  • Warranties that defects will be corrected

Fishing and Product Information

Tacklr provides a platform for creators to share fishing recommendations. We do not:

  • Guarantee the accuracy of fishing advice or product recommendations
  • Endorse or verify creator credentials or expertise
  • Guarantee fishing success or results from using recommended gear
  • Take responsibility for fishing safety or compliance with local regulations

You are responsible for verifying fishing regulations, obtaining necessary licenses, and ensuring your own safety when fishing.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TACKLR SHALL NOT BE LIABLE FOR:

  • Indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, revenue, data, or business opportunities
  • Personal injury or property damage related to fishing activities
  • Damages arising from third-party products or services
  • User content or conduct

Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.

Indemnification

You agree to indemnify, defend, and hold harmless Tacklr, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including legal fees) arising from:

  • Your use of the Services
  • Your Content
  • Your violation of these Terms
  • Your violation of any rights of another party
  • Your affiliate links or product recommendations

Dispute Resolution

Informal Resolution

If you have a dispute with us, please contact us at hello@tacklr.co to attempt an informal resolution before taking any formal action.

Governing Law

These Terms are governed by and construed in accordance with the laws of the United States and the state in which Tacklr is incorporated, without regard to conflict of law principles.

Arbitration

Any disputes arising from these Terms or the Services shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except where prohibited by law. You waive your right to participate in class action lawsuits.

General Provisions

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Tacklr regarding the Services.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.

Waiver

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision.

Assignment

You may not transfer or assign your rights under these Terms without our prior written consent. We may assign our rights and obligations without restriction.
